Please read these Terms of Service and Data License Agreement carefully before using the BCAR DATA website or purchasing any data products. By accessing this website or purchasing Data from BCAR DATA, you agree to be bound by the terms set forth below.

Overview & Acceptance of Terms

These Terms of Service and Data License Agreement (collectively, this “Agreement”) govern your use of the BCAR DATA website (bcardata.com) and your purchase and use of permit data, lead lists, and related reports (collectively, “Data”) provided by BCAR DATA (“we,” “us,” or “BCAR DATA”).

By accessing or using this website, or by purchasing or accessing any Data, you (“Customer,” “Licensee,” or “you”) accept and agree to be bound by this Agreement in its entirety. If you do not agree, you may not use this website or purchase any Data.

BCAR DATA compiles building permit records sourced from publicly available government records and delivers them to customers via email in spreadsheet or report format.

Website Use

Access to and use of this website is granted for lawful purposes only. You are permitted to temporarily download one copy of materials from this website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

Modify or copy the materials for commercial use or public display
Attempt to reverse engineer any software or systems underlying the website
Remove any copyright or proprietary notations from the materials
Transfer the materials to another person or mirror them on any other server

This license shall automatically terminate if you violate any of these restrictions and may be terminated by BCAR DATA at any time.

Data License Grant

Permitted Uses

Subject to the terms of this Agreement, BCAR DATA grants you a non-exclusive, non-transferable license to use the Data for the following purposes:

Internal business use, including sales prospecting, marketing, and lead generation
Incorporation into reports or deliverables provided to your own clients, provided BCAR DATA is cited as the data source
Sharing within your organization or with contractors working directly on your behalf

Restrictions

You may not, without prior written consent from BCAR DATA:

Resell, sublicense, or redistribute the Data as a standalone data product to third parties
Use the Data to build or operate a competing permit data service or lead list business
Scrape, reverse engineer, or attempt to reconstruct BCAR DATA’s sourcing methods or processes
Represent the Data as your own proprietary data without attribution to BCAR DATA

Data Delivery

BCAR DATA delivers purchased Data via email to the address provided at checkout. Delivery typically occurs within 10 business days of confirmed payment. BCAR DATA is not responsible for delays caused by incorrect email addresses or other errors introduced by the Customer.

For monthly subscribers, Data is delivered on a recurring basis. It is the Customer’s responsibility to ensure their email remains active and capable of receiving files. BCAR DATA will make reasonable efforts to re-deliver in the event of a failed delivery upon request.

Payment & Refund Policy

Single Purchases

Single-month purchases are charged at the time of order. All sales are final. Due to the digital nature of the Data, refunds are not available once the Data has been delivered.

Subscriptions

Monthly subscriptions are billed on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. No prorated refunds are issued for partial months. BCAR DATA reserves the right to adjust subscription pricing with 30 days’ written notice.

All amounts are exclusive of applicable taxes. The Customer is responsible for any sales, use, or similar taxes imposed on the purchase.

Data Accuracy & Disclaimer

BCAR DATA sources permit data from publicly available government records. While we make reasonable efforts to ensure accuracy and completeness, we do not guarantee that the Data is error-free, complete, or current at the time of delivery. Building permit data is subject to lag times and inconsistencies inherent in government record-keeping.

ALL DATA AND WEBSITE MATERIALS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. BCAR DATA DISCLAIMS ALL SUCH WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW.

Ownership & Intellectual Property

The underlying government permit records are public data. However, BCAR DATA’s compiled datasets, formatting, organization, and reports are proprietary. All intellectual property rights in the Data as compiled and delivered by BCAR DATA remain with BCAR DATA. This Agreement grants you a license to use the Data — not ownership of it.

Confidentiality

You agree to treat BCAR DATA’s sourcing methods, data processing workflows, pricing structures, and any non-public business information as confidential, and not to disclose them to third parties without BCAR DATA’s prior written consent.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BCAR DATA’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE DATA IN THE THREE (3) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL BCAR DATA BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR PROFIT, OR DAMAGES ARISING FROM BUSINESS INTERRUPTION, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

Term & Termination

This Agreement begins when you first access this website or purchase Data, and continues for as long as you hold or use that Data. BCAR DATA may terminate or suspend your access if you materially breach these terms and fail to cure such breach within 10 days of written notice. Upon termination, you must cease use of the Data and delete all copies in your possession.

For subscriptions, either party may terminate at any time per Section 5.2. Termination does not affect obligations accrued prior to the termination date.

Modifications to This Agreement

BCAR DATA may update these terms from time to time. When changes are made, the updated version will be posted at bcardata.com with a revised “Last Updated” date. Your continued use of the website or Data following any such update constitutes acceptance of the revised terms. We encourage you to review this Agreement periodically.

General Provisions

Governing Law

This Agreement is governed by the laws of the State of California without regard to its conflict of laws provisions.

Entire Agreement

This Agreement constitutes the entire understanding between you and BCAR DATA regarding the use of this website and the purchase and use of the Data, and supersedes any prior communications or agreements on these subjects.

Severability

If any provision of this Agreement is found to be unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

Waiver

Failure by BCAR DATA to enforce any right or provision of this Agreement shall not constitute a waiver of that right or provision.
